JOBS By Developer Kaki ("we", "us" and/or "our") owns and operates JOBS By Developer Kaki ("Site"). These Terms of Use govern your use of our tools, products and services ("JOBS By Developer Kaki"). For questions or feedback regarding these Terms of Use or our offerings, please contact us.

Acceptance of Terms

These Terms of Use apply to all Site users, whether you're a content creator, consumer (paid or unpaid subscriber), or other user. Using the Site indicates your acceptance of these Terms of Use, including all contents herein, along with our Privacy Policy, Content Guidelines, Creator Agreement, Content Policy, Community Guidelines, and related policies (collectively, "Other Policies"). We reserve the right to modify these Terms of Use at our sole discretion without prior notice. Please review these Terms periodically for updates, which you can track via the "LAST UPDATED" date above. Your continued Site usage confirms your acceptance of current Terms of Use and Other Policies, including any modifications. If you disagree with these terms, please stop using the Site.

You access and use the Site at your own risk and must comply with applicable Malaysian laws. By using the Site, you confirm that you're legally old enough to agree to these Terms of Use (or have parental/guardian consent). If representing an organization, you confirm your authority to bind that organization to these Terms (where "you" and "your" refer to said organization). You're responsible for all Site access through your internet connection and registered account, even if accessed by others.

Regulatory Compliance

Our platform operates in compliance with Malaysian regulations including:

  • Personal Data Protection Act 2010 (PDPA)
  • Communications and Multimedia Act 1998 (CMA)
  • Consumer Protection Act 1999
  • Electronic Commerce Act 2006

Account Registration

Certain Site features require account registration. When registering, you agree to provide and maintain accurate, current information as requested in the registration form.

Your JOBS By Developer Kaki account name must be one you're entitled to use. Impersonating others is prohibited. We maintain the right to disallow, terminate, or reclaim account names at our discretion.

The Site is for your personal or organizational use only, not for third parties. Account transfers require our written approval. Your registration data is governed by our Privacy Policy which adheres to the Personal Data Protection Act 2010.

Your account requires email verification. You're responsible for maintaining your email account's security and verification code confidentiality. Update your account information promptly if you change or deactivate your email. We're not liable for security failures on your part.

Content Creation and Uploading

Content you publish, post, upload, share, and store (if original) on the Site belongs to you and is protected by Malaysian copyright and intellectual property laws ("Post"). This includes microblogging messages, blogs, articles, newsletters, comments, chats, text, information, photos, registration details, and discussion board contributions.

You're responsible for your Posts' compliance with Malaysian laws and third-party intellectual property rights. Share only content you're comfortable making public. You agree to indemnify us, our affiliates, officers, employees, agents, representatives, and successors against losses related to your Posts.

Content Rules:

  1. Don't use content you don't own without prior creator approval. Your Posts must respect others' legal rights.
  2. You grant us and our affiliates license to modify and use your Posts to improve our services and develop new features.
  3. Sharing Posts with other users grants them access rights as permitted by Site functionality.
  4. Your licenses to us are royalty-free, perpetual, irrevocable, and worldwide, while maintaining your content ownership.

We reserve the right to remove or limit any content violating these Terms or Malaysian laws, and may terminate accounts of repeat violators without notice.

Intellectual Property and Infringement Reporting

Comply with copyright notices, trademark rules, and intellectual property restrictions. We may delete content allegedly violating others' intellectual property rights and terminate repeat infringers' accounts.

For reporting potential infringement, please contact us. For our handling of such reports, we comply with Malaysia's Copyright Act 1987 and the Communications and Multimedia Act 1998, in accordance with guidelines set by the Intellectual Property Corporation of Malaysia (MyIPO) and the Malaysian Communications and Multimedia Commission (MCMC). Any content disputes are handled following MCMC's content code and regulatory framework.

JOBS By Developer Kaki's site content (excluding user contributions) is owned exclusively by JOBS By Developer Kaki. These Terms don't grant you rights to our trademarks, logos, or intellectual property.

General Practices Regarding Acceptable Use Policy

You're responsible for legal compliance in Site usage. Prohibited activities include:

  • Fraudulent or threatening behavior violating Content Guidelines
  • Compromising account security
  • Attempting to access others' security information
  • Network security violations
  • Spreading harmful code
  • Running automated processes that interfere with Site operation
  • Unauthorized data scraping
  • Commercial exploitation without written consent
  • Attempting to access Site source code

Third-Party Interactions

Users are solely responsible for their Posts. You access all content at your own risk and may encounter inappropriate material. We're not liable for Post content and you indemnify us against related damages.

We don't oversee user interactions or third-party website content. Disputes between users or with third parties are your responsibility. We may assist in user communications upon written request but assume no liability.

Account Cancellation

We may terminate accounts, reclaim usernames, or limit access at our discretion without notice.

You may delete your account anytime, which deletes associated Posts, though public content may remain available elsewhere. For account recovery assistance, please contact us.

Certain obligations survive account termination, including representations, warranties, payments, indemnifications, warranty disclaimers, liability limitations, ownership rights, privacy terms, and dispute resolution terms.

Privacy

We respect your privacy and handle information according to our Privacy Policy and in compliance with the Personal Data Protection Act 2010 (PDPA).

In accordance with Malaysian law, we don't knowingly collect information from individuals under 18 years of age. If you believe we have such information, please contact us.

Revisions to the Site

We may modify, suspend, or discontinue Site features and impose limits without notice as we improve our services.

Terms Violation

Terms violations may result in account termination or other actions we deem necessary. We determine violations at our sole discretion.

Additional Terms

  • The Site is provided "as-is" without warranties
  • We're not responsible for Site content accuracy or legality
  • No warranties for recommended tools or services
  • Liability limited to greater of RM500 or past 12-month payments
  • You indemnify us against third-party claims
  • Rights transfer requires our written consent
  • Malaysian law governs these Terms
  • Disputes settled by arbitration in Malaysia

These Terms of Use represent the entire agreement between you and JOBS By Developer Kaki, superseding previous agreements regarding Site usage.
